1. Applicability
These general terms and conditions apply to every offer made by Sisse Touch and to every agreement concluded with a consumer via the webshop.
By placing an order, the consumer agrees to these general terms and conditions. Deviations are only valid if confirmed in writing.
2. Offer and agreement
Sisse Touch sells clothing and clothing accessories. Offers are without obligation and are valid while supplies last.
Obvious errors, mistakes or misprints in the offer are not binding on Sisse Touch.
The agreement is concluded as soon as the consumer places an order and the payment has been successfully completed or authorized by the payment provider.
3. Pricing and payment
All prices include VAT, unless otherwise stated. Any shipping costs will be clearly shown before completing the order.
Payment can be made using the payment methods offered on the webshop, including iDEAL.
When paying via iDEAL, additional iDEAL conditions may apply. These will be shown to the consumer during the payment process.
4. Delivery and Performance
Delivery takes place at the delivery address specified by the consumer.
The indicative delivery time within the Netherlands is 2-5 working days, unless stated otherwise. Different delivery times may apply for Belgium and other countries.
Sisse Touch strives for timely delivery. In case of significant delay, the consumer will be informed.
If delivery proves permanently impossible, the consumer will receive a refund of the amount paid.
5. Retention of Title
Delivered products remain the property of Sisse Touch until the full purchase price, including any shipping costs, has been paid.
6. Right of withdrawal
The consumer has the right to withdraw from the agreement within 14 days after receiving the product, without stating reasons.
After notifying withdrawal, the consumer has another 14 days to return the product.
Withdrawal can be done by email, using the statutory model withdrawal form, or, if available, via the online withdrawal function on the webshop. The use of the model form is not mandatory.
Sisse Touch may withhold reimbursement until the product has been received or until the consumer has demonstrated that the product has been returned.
7. Return Policy
We kindly request that you return the product complete and in its original condition and packaging. If the product has been used more than necessary to establish its nature, characteristics, and functioning, a reduction in value may be charged in accordance with the law.
Returns must be registered in advance via info@sissetouch.com.
8. Return shipping costs
The direct costs of returning an item are at the consumer's expense, unless the product delivered is incorrect or defective.
For an incorrectly delivered or defective product, reasonable return costs will be reimbursed.
9. Refund
Upon receipt of the returned product or proof of shipment, Sisse Touch will refund the purchase amount within 14 days, using the same payment method as the original transaction, unless otherwise agreed.
If the consumer has chosen a more expensive shipping method than the standard delivery, Sisse Touch is not obliged to refund the additional costs.
10. Exceptions to the right of withdrawal
The right of withdrawal does not apply to custom-made products and sealed hygiene products whose seal has been broken after delivery, to the extent permitted by law and clearly stated in advance.
For clothing and clothing accessories, the right of withdrawal generally does apply, unless a legal exception is applicable.
11. Warranty and conformity
Consumers are entitled to a product that complies with the agreement and with the legal requirements of conformity.
Any manufacturer warranties or commercial warranties do not detract from the statutory rights of the consumer.
12. Complaints
Complaints can be submitted via info@sissetouch.com.
Sisse Touch aims to respond substantively to complaints within 14 days.
If a complaint cannot be resolved mutually, the consumer can turn to an authorized dispute resolution body or the competent court.
13. Liability
Sisse Touch is not liable for indirect damage, consequential damage, or damage due to misuse of products, except if this results from mandatory law, intent, or gross negligence.
Liability is, to the extent permitted by law, limited to the amount of the relevant order.
14. Force majeure
Sisse Touch is not liable for delays or shortcomings due to force majeure, including disruptions at carriers, system failures, government measures, strikes, or other circumstances beyond its reasonable control.
15. Privacy
Personal data is processed in accordance with Sisse Touch's privacy policy.
16. Applicable Law
All agreements are governed by Dutch law.
Disputes will be submitted to the competent Dutch court, unless mandatory consumer law dictates otherwise.
17. Amendment to the general terms and conditions
Sisse Touch reserves the right to amend these general terms and conditions. The terms and conditions applicable to an agreement are always those that were in force at the time of purchase.
